BRITISH MICROLIGHT AIRCRAFT ASSOCIATION (BMAA)
These terms and conditions govern the contract under which the BMAA will supply Flight Training Vouchers to you. When the user, recipient, of the Voucher books the flight with a training flight provider they will enter into a separate contract with the provider of the flight and become subject to the providerís own terms and conditions.
INSURANCE AND SAFETY
All flying activity involves some personal risk. In purchasing one of our Flight Training Vouchers you accept the existence of an element of risk. Personal life insurance and personal accident insurance policies vary in their coverage, and some exclude certain activities. It is advisable to check if your personal insurance policy excludes Microlight Flight Training.
The Flight Training Providers used by the BMAA are required to carry their own flight insurance and general public third party liability insurance.
The BMAA are not operators of aircraft or providers of carriage by air. We are unable to give any guarantee as to the safety standards or performance of any operator. The operator may require a disclaimer to be signed before the flight takes place.
We cannot accept any responsibility for any loss howsoever arising from our contract with you for the supply of Flight Training Vouchers (save in the
case of death or personal injury caused by our negligence).
Liability for any delay or cancellation of the flight training or loss, injury, death or any other claim howsoever arising from or howsoever caused by the flight training taken in respect of the voucher ordered through the BMAA, shall be the sole responsibility of the operator who provides the flight training and shall be governed by that operator's terms and conditions.
Gift Vouchers are dispatched by first class Royal Mail, recorded delivery. We will not be liable for any cost, loss or inconvenience suffered due to delayed or lost mail.
Gift Vouchers are valid for 12 months from the date of purchase and must be redeemed before the expiry date.
The BMAA endeavours to give accurate and detailed information about the training flights and providers. However there may be changes in the exact arrangements on the day or during the course of the 12 months lifetime of the voucher. These descriptions should therefore be taken as a guide only and do not form part of the contract. Photographs used are illustrative and not necessarily of the actual equipment in use at any particular location, In the event of an element of a flight not being completed and no satisfactory alternatives being supplied the maximum compensation available is limited to the net cost of the element not completed,
Flight training in microlight aircraft is subject to an age restrictions by law. The minimum age for flight training is 14 years. If the recipient is under 18 the written consent of a parent or legal guardian will be required by the training provider.
Microlight aircraft are by definition light weight and have limited occupant weight capacity. Many microlight aircraft are limited to carrying persons weighing up to 90 Kg. Some aircraft can carry persons weighing up to 110 Kg. You must check with your chosen training provider, when making your booking, that the aircraft can accommodate the weight of your recipient.
Microlight flying itself does not require great strength or unusual agility. However you will need to be agile enough to get in and out of the particular aircraft in use and must be medically fit enough for the activity. If you have any doubts about medical fitness, you should consult your doctor prior to booking the flight training and always advise the Flight Training Provider of any disability or condition that you think may be relevant.
We advise that the user makes a flight booking as soon as possible before the preferred date to avoid disappointment. No guarantee can be made as to the availability of flight training on any particular day so please be as flexible with your booking dates as possible.
Waiting time may be necessary with all flight training, especially as it is weather dependant. There is also the possibility of short notice cancellation due to weather, mechanical problems, staff illness or other unforeseen circumstances beyond the operatorís control. If the flight is cancelled the recipient should simply re-book with the operator concerned. The BMAA will not be liable for any costs such as travel or accommodation incurred by the participant in such circumstances. Once the user has booked the flight training they become subject to the provider's terms and conditions including the provider's cancellation terms. This may mean that if the user cancels a booking the user may forfeit the flight training. Should flight training become unavailable at a particular location for any reason whatsoever after you have received your voucher we will endeavour to find an acceptable alternative location. Failing this we reserve the right to give a full refund. This will be made to the purchaser of the voucher. This will be the limit of our liability and we will not be liable for any other costs incurred by the participant such as travel or accommodation.
The easiest way of resolving any complaint is to address them on the day. If your complaint cannot be resolved on the day please inform us by writing to our Customer Services Manager.
You can claim a refund up to 7 days after placing an order with the BMAA unless the flight training has already been booked with a provider. Thereafter all Flight Training Vouchers are non-refundable. Note that refunds can only be made to the purchaser. Refunds will not be made to the user or any third party. Refunds will not be given on expired vouchers.
