Professional Indemnity Insurance for Flight Instructors

Microlight Flying Instructors have asked the BMAA to look for Professional Indemnity Insurance that would cover them if a student, or indeed a past student, was injured or suffered a loss and made a claim for compensation against the instructor. For example a student pilot crashes their aircraft and then claims that the instructor has somehow failed to give proper instruction which would have prevented the accident. Although the instructor may have comprehensive student records showing that he had covered the particular technique or scenario it can be very expensive to defend a claim even if it is not proved. This is where a Professional Indemnity Insurance can help.

The brokers CSP have been able to develop with underwriters a Professional Indemnity Insurance policy which addresses the request of the Microlight Instructors. The details provided by CSP are:

“The policy would cover any case which may be brought against an instructor being accused of negligence following an accident which involved a pilot trained by them. The policy would exclude dual instruction because as you know our policies already automatically give instructors cover for their dual student under the passenger section of the liability policy.

As we discussed this policy offers protection for the instructor against any legal costs involved in defending a case of negligence which currently isn’t covered under their aviation liability policy. We feel this is a very real problem these days with the culture of ‘no win/no fee’ lawyers looking into all avenues of claiming compensation. This policy will offer expertise to defend these potential cases without the instructor having to find thousands of pounds or potentially losing his livelihood or worse still house etc. defending the case.

The policy will be based on the annual turnover of each flying school business and I think in the microlight community most businesses will fall within the first band.

Before CSP launches this policy they need to know that there will be sufficient take-up to make it worthwhile.
